Finishing up a case for a union electrician who slipped and fell on a construction site in D.C. and hurt his neck. The workers comp insurance denied it because he had been in active pain management for the last 5 years for chronic neck pain. And his pain management group wouldn’t treat him for the new injury. So we worked with his new treating doctor to get some evidence of an aggravation of the underlying condition. To his credit, he let us play chicken with the insurance company, not settling until the last minute, which got him an extra $100K. Sometimes you just gotta hang in there.
