Congress Attempts to Pass More Legislation to Hurt Injured Patients

An article by the American Association for Justice says members of Congress are trying to repeal and replace the Affordable Care Act (ACA) with a federal medical malpractice proposal, using the Commerce Clause to prove constitutional authority. If passed, this legislation would strip injured patients of all legal rights – simultaneously stripping incentive for healthcare providers to improve patient safety. Patients hurt by negligence, nursing home abuse, or defective drugs and devices would have no means for justice.  According to the article, after the Supreme Court ruling it is clear that the legislation’s efforts exceed Congress’s Commerce authority and violate our system of federalism.
