If passed, this legislation would strip injured patients of all legal rights – simultaneously stripping incentive for healthcare providers to improve patient safety. Patients hurt by negligence, nursing home abuse, or defective drugs and devices would have no means for justice. According to the article, after the Supreme Court ruling it is clear that the legislation’s efforts exceed Congress’s Commerce authority and violate our system of federalism.
